Privacy Policy

Nightsesh ("Nightsesh", "we", "us") is an AI study platform for iPhone, iPad and Mac, made by Sparks Strategies LLC. You can study by chat (Chat study), by talking out loud (Voice study), by listening (Walk & study), and by recording your classes and turning them into notes. This policy explains what information Nightsesh collects, why, who helps us process it, how long we keep it, and the choices you have. We wrote it in plain English. The short version
- Nightsesh is for students 13 and older. We don't knowingly create accounts for children under 13.
- No ads. We don't sell your information, don't share it for advertising, and don't track you across other companies' apps or websites. Nightsesh has no third-party advertising or analytics code.
- We collect what we need to run Nightsesh: your sign-in, the study material you add, your notes, cards and progress, your chats, and your purchases.
- Nightsesh's AI uses Anthropic (text and images) and OpenAI (voice). Class recordings, board photos, scanned pages and dictation are turned into text on your device. The audio and pictures aren't uploaded.
- We don't train AI models on your information, and our AI providers don't either.
- You can delete your account and data at any time in the app: Settings › Account › Delete account.
1. Who this policy covers
This policy covers the Nightsesh apps (including test versions in Apple's TestFlight), the Nightsesh service behind them, and these web pages. It doesn't cover Apple's App Store, Sign in with Apple, Siri, or other companies' apps and websites. Their own privacy policies apply.
2. Age requirement
You must be at least 13 to use Nightsesh. Before you sign in, Nightsesh asks you to confirm you're at least 13, and we record the time you did. We don't ask for your birth date. Nightsesh isn't directed to children under 13, and we don't knowingly collect personal information from them. If we learn that someone under 13 has an account, we'll delete it and its data. If you're a parent and think your child under 13 is using Nightsesh, email us and we'll delete the account.
If you're 13 to 17, please use Nightsesh with your parent or guardian's knowledge. Purchases go through Apple, where a parent can approve them with Ask to Buy.
3. What we collect

Live voice
Voice study is a live conversation. While a call is on, your microphone audio and the lesson on screen go straight from your device to OpenAI. Our server only starts and ends the call and counts its length. If you ask about your notes during a call, Nightsesh looks them up on your device and sends the matching passages into the conversation. OpenAI also turns what you say into text, so the app can show crisis support if you say something worrying (section 12). That text is used on your device and isn't saved. We don't record or store call audio or transcripts.

This doesn't use your advertising identifier and doesn't identify your device. |

We don't collect your location, contacts, advertising identifier (IDFA), browsing history, health data, or voiceprints or other biometric identifiers. Nightsesh doesn't read other apps or your screen.
4. What stays on your device
- Class recordings are saved on your iPhone, iPad or Mac and turned into text there by Apple's built-in speech recognition. That includes the live transcript, captions and "Catch me up" while you record. The audio is never uploaded, including recordings you import.
- Board photos, slide pictures and photos you add to notes are read on your device by Apple's text recognition. The pictures stay on the device. The text read from them becomes part of your notes.
- Photos of notes, scans and handwriting you add to a Subject are read on your device. Only the text is uploaded.
- Dictation uses Apple's speech recognition on your device.
- Small helpers that suggest a Subject name, reword an explanation more simply, or turn a search into likely terms run on Apple Intelligence on your device, where it's available.
- Caption translation uses Apple's translation on your device.
- Spotlight and Siri: your notes are indexed on your device so Spotlight can find them. When you use Siri or Shortcuts, Apple's privacy policy covers what you say to Siri.
- Study reminders are scheduled on your device.
- A copy of your Subjects, notes and progress is kept on your device so you can study offline.
What's stored on your device stays there until you delete it or delete the app. It may be included in your device or iCloud backups, which Apple's policies cover.
5. How we use information
- To run Nightsesh: sync your material and notes, make cards and notes, answer your questions, run voice calls and walks, and apply plan limits.
- To keep Nightsesh safe: apply our teen safety rules, show crisis support, review reports, and prevent abuse and fraud.
- To handle purchases and support requests.
- To fix bugs and improve Nightsesh, using feedback you send, error logs, and totals from usage counts. We never use it to build advertising profiles.
We don't look through your study material, notes or chats. We see them only when you send them to us in a report or support request, when we need to fix a problem you've asked us to fix, to investigate abuse or a safety concern, or when the law requires it.
We don't use your information for ads. We don't sell it or "share" it (as California law defines "share"). We don't use it for profiling that has legal or similarly significant effects on you. We don't train AI models on it, and our AI providers don't either (section 6).
6. Who helps us (service providers)
We use a small number of companies to run Nightsesh. They may use your information only to provide their service to us.

Before any of your material goes to an AI provider for the first time, Nightsesh asks you. You can turn AI study help off at any time in Settings › AI & privacy. Turning it off stops new AI requests and ends an active voice call. It can't recall material that was already processed. You can still study the cards and notes you already have.
We may also disclose information:
- if the law requires it (for example, a valid court order)
- to protect someone's safety
- to investigate or prevent abuse or fraud
- as part of a business transfer (for example, a merger or sale), in which case this policy would still apply to your information
- when you ask us to (for example, when you share a Subject)
7. Sharing a Subject with classmates (when you choose)
On plans that include sharing, you can share a Subject's cards with classmates you approve:
- You publish the Subject and send an invite link. Links expire.
- Someone who opens the link asks to join and gives a display name, which you see. You decide who gets in.
- People you approve see the Subject's title and its cards: questions, answers, explanations, topic names and citation labels (such as "Slide 12"). They don't see your original files, notes, recordings, transcripts, chats or progress, and they don't see your name or email.
- Their own progress on your cards is saved to their account.
- You can remove someone at any time. After that, they can't get the Subject from our service. They can report a shared Subject and block the person who shared it.
8. How long we keep information
- While your account is open, we keep your study material, files, notes, cards, chats, progress, usage records and purchase records so you can use them.
- Deleting things yourself: deleting a Subject deletes it from our database, along with its material, cards, chats and progress. Deleting a note removes its content from our servers. A small marker stays so the deletion reaches your other devices. The saved result of each notes request is kept until you delete your account.
- Chat study reminders expire automatically and are then deleted: open questions after 7 days, practice gaps after 30 days, and study preferences after 60 days. New evidence restarts the clock. You can clear them any time: Settings › AI & privacy › Clear what Chat study remembers.
- Usage counts and Apple Ads attribution are kept while your account is open and deleted with it.
- Feedback and reports are kept while your account is open so we can follow up and track fixes.
- When you delete your account, we immediately delete from our live systems your sign-in record, profile, uploaded files, Subjects, study material, cards, chats, reminders, notes, notes requests, progress, usage records, usage counts, attribution, feedback, invite records, and purchase and balance records. Anyone you shared a Subject with loses access to it.
- Our database provider may keep backup copies. Any copies are removed as its backups roll over, within 30 days.
- Technical logs expire on their own, currently within 7 days.
- Our AI providers keep request data only as described in section 6.
- Apple keeps its own purchase records.
- Copies on your own devices stay until you delete them or the app.
- We may keep limited information longer if the law requires it, or to resolve a dispute, prevent fraud or enforce our Terms.
9. Your choices and rights
- Delete your account: Settings › Account › Delete account in the app. You can also email us. Deleting your account doesn't cancel an Apple subscription. Cancel it in your Apple Account settings.
- Turn AI study help on or off: Settings › AI & privacy.
- Clear what Chat study remembers: Settings › AI & privacy.
- Turn off usage counts (and Apple Ads attribution): Settings › Help make Nightsesh better › Share usage counts.
- See, correct or get a copy of your information: email us. We'll reply within 45 days. If we need more time (up to 45 more days), we'll tell you why.
- Parents and guardians of a user under 18 can contact us to ask what we have, get a copy, or have their teen's data deleted.
We'll take reasonable steps to confirm that a request really comes from you, or from someone you've authorized. For example, we may ask you to write from the email address on your account or to confirm something only you would know. We use what you give us for this only to handle the request.
U.S. state privacy rights
Depending on where you live (for example California, Colorado, Connecticut, Delaware, Maryland, Oregon, Texas or Virginia), you may have the right to:
- know what personal information we have about you and access it
- correct it
- delete it
- get a copy in a portable format
- opt out of the sale of your information, targeted advertising, and profiling that has legal or similarly significant effects (we don't do any of these)
- not be treated differently for using your rights
To use these rights, email [email protected]. You can also have an authorized agent send a request for you. We may ask the agent for proof that you gave permission, and we may ask you to confirm your identity with us directly.
Appeals. If we turn down your request, in whole or in part, we'll explain why. You can appeal by replying to our answer or by emailing us with "Appeal" in the subject line. We'll answer your appeal in writing within 45 days and explain what we decided and why. If you disagree with the result of your appeal, you can contact your state's attorney general. For example, Colorado residents can go to coag.gov, Connecticut residents to portal.ct.gov/ag, and Virginia residents to oag.state.va.us.
Teens
We don't sell teens' information, don't show them targeted ads, and don't profile them for decisions with legal or similarly significant effects. This goes for every user, whatever their age.
Global Privacy Control and "Do Not Track"
We don't sell or share personal information and don't track you across other sites or apps, so there's nothing to opt out of. If your browser or device sends a Global Privacy Control signal, we'll treat it as a request to opt out of sale and sharing, just in case.
California
- Categories. In the past 12 months we've collected the categories below. We got them from you, from your device, and from Apple (sign-in, purchases, Apple Ads attribution). We use them for the purposes in section 5 and disclose them only to the service providers in section 6:
- identifiers: Apple account ID, email address, IP address, random install ID
- commercial information: plan and purchase records
- internet or other electronic activity: usage counts, usage and limit records, technical logs
- audio: your voice during a live voice call, streamed to OpenAI and not stored by us
- inferences about your studying: mastery and Chat study reminders
- the content you add: study material, notes, chats, feedback
- No selling or sharing. We haven't sold or shared personal information in the past 12 months, including that of consumers under 16.
- No sensitive-information inferences. We don't use sensitive personal information to infer characteristics about you.
- Retention. We keep each category for the periods in section 8.
- "Shine the Light." We don't disclose personal information to others for their own direct marketing.
- Users under 18 in California can remove content they've posted on Nightsesh. Delete it in the app (for example, stop sharing or delete the Subject), or email us to ask us to remove it. Removing it from Nightsesh may not remove copies others already made.
10. Security
- Connections to Nightsesh are encrypted (HTTPS/TLS).
- Data is stored with a provider that encrypts it at rest.
- Database rules limit each account to its own data.
- Keys for our AI providers stay on our servers, never in the app. Voice calls are set up by our server, and the app only gets a handle for its own call.
- Sign-in tokens are kept out of our logs.
No system is perfectly secure. If a breach affects your information, we'll notify you and the authorities as the law requires.
11. Nightsesh's AI
- Chat study, Voice study and Walk & study are powered by Nightsesh's AI. It's AI, not a person, and it can make mistakes. Nightsesh shows where answers came from in your material so you can check.
- Every AI request includes safety rules we wrote for teens.
- Nightsesh's AI doesn't make decisions about you that have legal or similarly significant effects.
12. Safety features
- If a message you type, or something you say in Voice study, suggests you may be in danger, Nightsesh shows support right away: call or text 988 (Suicide & Crisis Lifeline), or call 911 in an emergency. The AI is also told to respond with those numbers.
- This check runs on your device. It doesn't notify anyone, including your parents, your school or emergency services, and it never blocks studying.
- We review reports sent through the app to keep Nightsesh safe.
13. Where we operate
Nightsesh is offered in the United States. We and our database and hosting providers store and process information in the United States. If you use Nightsesh from somewhere else, your information will be transferred to the United States.
14. Changes to this policy
If we change this policy, we'll update the date at the top. If a change is important, we'll tell you in the app before it takes effect. If we ever want to use your information in a way this policy doesn't allow, we'll ask you first.
